1. ACCEPTANCE OF TERMS

1.1 Binding Agreement

Welcome to ASM Store (hereinafter "ASM Store", "we", "our" or "the Company"). By accessing, browsing or using our website www.asmstoreautoparts.com (hereinafter "the Site"), making a purchase, creating an account or using any of our services, you (hereinafter "User", "Customer" or "you") expressly agree to be bound by and comply with these Terms and Conditions of Service (hereinafter "the Terms").

IF YOU DO NOT AGREE WITH THESE TERMS, DO NOT USE THIS SITE OR MAKE PURCHASES.

1.2 Legal Capacity

By accepting these Terms, you declare and warrant that:

  • You are over 18 years of age or have the consent of a parent/legal guardian
  • You have legal capacity to enter into binding contracts
  • All information you provide is true, accurate and complete
  • You will use the Site in accordance with these Terms and applicable law

1.3 Modifications

ASM Store reserves the right to modify these Terms at any time. Changes will take effect immediately upon publication on the Site. It is the User's responsibility to periodically review these Terms.

2. DEFINITIONS

"ASM Store": Colombian company dedicated to the sale of auto parts for American vehicles, with registered trademark MMAS Automotive and trade name ASM Store.

"Site": The website www.asmstoreautoparts.com and any subdomain, mobile application or digital platform operated by ASM Store.

"Products": Auto parts, spare parts, accessories and components for American vehicles (Jeep, Dodge, Ford, Chrysler) offered for sale on the Site.

"User" or "Customer": Any person who accesses the Site, creates an account or makes a purchase.

3. USE OF THE WEBSITE

3.1 Limited Use License

ASM Store grants the User a limited, non-exclusive, non-transferable and revocable license to access and use the Site solely for personal and legitimate commercial purposes related to the purchase of Products.

3.2 Use Restrictions

The User agrees NOT to:

❌ Use the Site for illegal or unauthorized purposes
❌ Attempt to access restricted areas of the Site
❌ Interfere with the operation of the Site
❌ Copy, reproduce or distribute Content without authorization
❌ Use bots, scrapers or automated tools to extract data
❌ Transmit viruses, malware or malicious code
❌ Impersonate another person or entity
❌ Use the Site for spam, phishing or fraudulent activities

4. ACCOUNT REGISTRATION

Users may make purchases as guests (without account) or create a registered Account.

Benefits of creating an account: order history, simplified tracking, saved addresses, faster checkout and priority access to promotions.

The User is responsible for maintaining the confidentiality of their account credentials. ASM Store is not liable for unauthorized access due to the User's failure to protect their credentials.

5. PRODUCTS AND COMPATIBILITY

5.1 Product Compatibility Responsibility

CRITICAL WARNING: The User is responsible for verifying that the product is compatible with their specific vehicle before purchasing. ASM Store provides free compatibility consultation. Providing incorrect vehicle information (make, model, year, engine) will void the return/warranty claim.

We recommend consulting our technical team before purchasing if you have any doubts about compatibility.

5.2 Product Descriptions

ASM Store strives to display accurate and complete product descriptions, including specifications, photos, compatibility and other relevant information. Minor variations in color or appearance may exist due to photography conditions.

6. PRICES AND PAYMENT

6.1 Prices

All prices are displayed in Colombian Pesos (COP) and include applicable taxes, unless otherwise specified. ASM Store reserves the right to modify prices at any time without prior notice.

6.2 Accepted Payment Methods

✓ Credit and debit cards (Visa, Mastercard, American Express)
✓ PSE (electronic bank transfer)
✓ PayPal (national and international)
✓ Cash (in physical store only)
✓ Bank deposit
✓ Credit for registered corporate clients (prior approval required)

6.3 Payment Security

Payments are processed through Shopify Payments, Mercado Pago and PayPal. ASM Store does not store complete credit card information. All transactions are encrypted with SSL/TLS technology.

6.4 Payment Confirmation

Your order will only be processed and shipped after payment is confirmed. Bank transfers may take 1-2 business days to reflect.

7. ORDERS AND CANCELLATIONS

7.1 Order Confirmation

After completing your purchase, you will receive a confirmation email with order details. This email does not guarantee final acceptance of the order. ASM Store may cancel orders in cases of stock unavailability, payment issues or suspected fraud.

7.2 Order Cancellation

By the Customer: Cancellations are accepted within 24 hours of order placement, as long as it has not yet been shipped. Contact us via WhatsApp to request cancellation.

By ASM Store: We may cancel orders without prior notice in cases of: stock unavailability, pricing error, suspected fraud, payment that cannot be verified.

8. SHIPPING AND DELIVERY

Shipping is subject to our Shipping Policy, which forms an integral part of these Terms.

9. RETURNS AND WARRANTY

Returns and warranty are subject to our Warranty & Returns Policy, which forms an integral part of these Terms.

10. INTELLECTUAL PROPERTY

All content on the Site - including but not limited to texts, images, logos, graphics, videos, product descriptions and software - is the exclusive property of ASM Store or its licensors. Reproduction, distribution or commercial use of any content without prior written authorization from ASM Store is strictly prohibited.

11. LIMITATION OF LIABILITY

ASM Store shall not be liable for:

✗ Indirect, incidental, special or consequential damages
✗ Loss of profit, data or business
✗ Damages caused by incorrect installation of products
✗ Damages caused by providing incorrect vehicle information
✗ Service interruptions beyond our control

In any case, ASM Store's maximum liability shall be limited to the amount paid for the specific product or service that gave rise to the claim.

12. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of the Republic of Colombia. Any dispute will be submitted first to direct negotiation (30 days), then to mediation before the Bogotá Chamber of Commerce, and ultimately to the competent courts of Bogotá D.C., Colombia.
